SecondLock Terms of Use

1. Who these terms are between
- These terms govern your use of SecondLock ("the App"), an iPhone application provided by SecondLock ("we", "us"), a sole trader based in Japan.
- By downloading or using the App, you agree to these terms.
- Nothing in these terms takes away rights you have under the mandatory consumer laws of the country you live in. Where those laws conflict with anything below, those laws win.
2. What the App does
- The App encrypts photos and videos you choose and stores them on your iPhone.
- With a paid plan, the encrypted data is also stored in your own iCloud account, and can be restored on another iPhone. Where the data lives is your iCloud account; the plan is bought through your App Store account. These two can be set to different accounts. To restore, you need both of them — the same iCloud account the data was saved to, and an App Store account that holds an active plan — plus your PIN.
- The App has no feature for sending data to other people.
3. How the encryption works, and what it can't do
This section is not a disclaimer. It describes how the App actually works. Please read it before you rely on the App.
- Your data is encrypted with a key derived from the PIN you choose. We do not hold that key and cannot read what you store.
- If you forget your PIN, nobody — including us — can recover your data. This is a limitation of the design, not a support issue. Contacting us cannot resolve it.
- The App asks you to confirm that you understand point 2 during setup. If you don't agree, you can't use the App.
- iOS gives apps no way to block screenshots. The App stops displaying content while the screen is being recorded, but it cannot prevent a screenshot, and it cannot prevent someone photographing your screen with another device.
- Storing data in iCloud uses your own iCloud storage. If you run out, you may need a larger storage plan from Apple. That is a separate agreement between you and Apple, and we are not part of it.
4. Your responsibilities
- You are responsible for making sure that what you store is lawful where you live and does not infringe anyone else's rights.
- As described in section 3, we cannot read what you store. We are therefore not in a position to review it and have no obligation to do so.
- You are responsible for providing the iPhone, network access, Apple Account and iCloud storage needed to use the App.
5. What you must not store or do
You must not use the App to:
- Store child sexual abuse material, or any image or recording of a minor made for sexual purposes.
- Store intimate images of any person made or kept without that person's consent.
- Store any content that is unlawful where you live.
- Store content that infringes another person's copyright, likeness, privacy or other rights.
- Reverse engineer, decompile, or modify the App.
- Bypass, or attempt to bypass, the App's authentication.
We cannot see what you store, so we cannot enforce this by inspection. It is stated because it is the condition on which you may use the App, and because storing the material listed above is a serious crime in every country where the App is sold.
6. Paid plans
- Purchases and payments are handled by Apple through the App Store. We never see your payment details.
- Subscriptions renew automatically at the price shown at purchase, unless cancelled at least 24 hours before the end of the current period.
- You cancel in the Settings app on your iPhone, under your Apple Account → Subscriptions. We cannot cancel on your behalf.
- If you cancel, you keep unlimited free access to view, decrypt and export everything you have already stored. What ends is new uploads to iCloud and restoring onto a new iPhone.
- Refunds are handled by Apple under Apple's refund policy. We cannot issue refunds ourselves.
- If you forget your PIN and can no longer open your vault, your subscription does not stop renewing. We have no way to stop your billing — only you can, using the cancellation steps in 6.3. The App shows you how to get there from the lock screen, even when the vault cannot be opened.
7. Our liability
- If we cause you loss through our own fault, we will compensate you for it.
- Except where we act intentionally or with gross negligence, our total liability is limited to the amount you paid us in the 12 months before the loss.
- Nothing in this section limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, for fraud, and any other liability that mandatory consumer law in your country does not allow to be excluded or restricted.

Subject to section 7.3, we are not liable for loss that is not caused by our fault. For example:
- You forgetting your PIN (section 3.2)
- Your iPhone failing, being lost, or being erased
- Failures or changes in iCloud, the App Store, or other Apple services
- Problems with your network connection
- Events outside anyone's reasonable control
This does not apply where our own fault caused the loss or made it worse.
8. Changing or discontinuing the App
- We may change what the App does, or stop providing it.
- If we stop providing it, we will give notice inside the App at least 90 days beforehand, so that you have time to export your data.
- If we stop providing the App, the data in your iCloud is not deleted. We don't hold it and have no power to delete it.
9. Intellectual property
The App itself belongs to us or to our licensors. Everything you store stays yours. We acquire no rights over it.
10. Changes to these terms
- We may change these terms.
- If a change is to your disadvantage, we will give notice inside the App at least 30 days before it takes effect, stating what changes and when.
- Price changes for existing subscribers follow Apple's procedures, which require your consent before a higher price is charged.
11. Governing law and disputes
- These terms are governed by the laws of Japan.
- This does not deprive you of the protection of the mandatory consumer laws of the country where you live, and it does not stop you bringing a claim in the courts of that country where the law gives you that right.
- Subject to point 2, which court hears a dispute is determined by the Japanese Code of Civil Procedure and other applicable law. We do not object to a dispute being resolved in the court covering the area where you live.
